KOMM TERMS OF SERVICE

Welcome to KOMM! These Terms of Service govern your use of KOMM , a platform designed to help individuals and organizations build, manage, and monetize communities. By accessing or using KOMM, you agree to be bound by these Terms. If you do not agree, please do not use the platform.
1. DEFINITIONS
- “User” refers to any person or entity that accesses or uses KOMM.
- “Community” refers to a group created on KOMM to engage members around a common interest or goal.
- “Services” refers to all features, tools, and functionalities provided by KOMM.
- “Content” includes but is not limited to text, images, videos, and other materials shared by users.
2. ELIGIBILITY
To use KOMM, you must be at least 18 years old or have parental consent if you are a minor. By using KOMM, you confirm that you are legally capable of entering into a binding agreement.
3. ACCOUNT REGISTRATION
- You must create an account to use certain features of KOMM.
- You are responsible for maintaining the confidentiality of your login credentials.
- We reserve the right to suspend or terminate accounts if we detect fraudulent activity or violations of these Terms.
4. ACCEPTABLE USE
Users must not:
- Post illegal, harmful, or offensive content.
- Engage in harassment, hate speech, or discrimination.
- Attempt to hack, disrupt, or misuse KOMM’s services.
- Share misleading or false information.
We reserve the right to remove content or suspend users who violate these guidelines.
5. COMMUNITY MANAGEMENT & MONETIZATION
- Community owners are responsible for the content shared within their groups.
- KOMM provides tools for monetization, including subscriptions and event ticketing. Users must comply with Kenya Revenue Authority (KRA) tax regulations.
- KOMM charges 8% per transaction.
6. PAYMENT TERMS
- Payments made through KOMM are processed securely via our integrated payment gateways.
- Refund policies for community memberships, events, and digital products are determined by the individual community owners.
- Users are responsible for ensuring compliance with applicable tax laws in Kenya.
7. PRIVACY POLICY
By using KOMM, you agree to our Privacy Policy, which governs how we collect, use, and protect your data. We do not sell your personal information to third parties.
8. INTELLECTUAL PROPERTY
- KOMM retains ownership of all intellectual property related to the platform.
- Users retain ownership of their content but grant KOMM a limited license to display, distribute, and promote it within the platform.
9. TERMINATION OF SERVICE
We may suspend or terminate your account if you violate these Terms. Users can also deactivate their accounts at any time.
10. DISCLAIMER OF WARRANTIES
KOMM is provided “as is” without warranties of any kind. We do not guarantee uninterrupted or error-free service.
11. LIMITATION OF LIABILITY
To the extent permitted by Kenyan law, KOMM shall not be liable for any indirect, incidental, or consequential damages resulting from the use of our platform.
12. GOVERNING LAW & DISPUTE RESOLUTION
These Terms shall be governed by the laws of Kenya. Any disputes arising from these Terms shall first be resolved through mediation. If mediation fails, disputes shall be resolved in Kenyan courts.
13. CHANGES TO TERMS
We may update these Terms periodically. Continued use of KOMM after changes means you accept the updated Terms.
